As the 2020 Census approaches, some Latinos in South Carolina are afraid the federal government will use the detailed census form information for immigration enforcement and possible deportation.<\/p>\n

In South Carolina, Hispanic and Latino groups could be under-counted by up to 11,300 people, according to the Urban Institute, a Washington-based nonprofit research organization. The Urban Institute\u2019s research shows that all minority groups are more likely to be under-counted. Interviews with Latino residents in the Midlands suggest the Urban Institute may be right. None wanted their names used but all expressed trepidation about the upcoming Census. “People are scared,” one business owner said.<\/p>\n

Nina Richards, managing attorney at Cano Law in Charleston, said she has heard many concerns from the Hispanic community about the way Census data will be used.<\/p>\n

The Census Bureau collects demographic data to determine where federal funding is allocated. It is bound by a law called Title 13, which states, \u201cThe Census Bureau collects information to produce statistics. Personal information cannot be used against respondents by any government agency or court.\u201d<\/p>\n

Trump’s 2016 campaign platform focused on the promise to build a wall between the U.S. and Mexico border and crack down on illegal immigrants from Mexico and Central America crossing the border.\u00a0 His administration also approved a controversial\u00a0 policy to separate families trying to cross the border, a policy that has been modified. Hundreds of unaccompanied migrant children still remain in government-managed detention centers today.<\/p>\n

During Trump’s time in office, he has also cancelled the Deferred Action for Childhood Arrivals (DACA) program that provides work authorization and temporary relief from deportation to unauthorized immigrants brought to the U.S. as children.\u00a0<\/p>\n

The Trump administration also wanted to add an untested citizenship question to the 2020 Census, arguing that it would\u00a0help the Justice Department enforce the Voting Rights Act on behalf of minority communities. The U.S. Supreme Court by a 5-4 vote blocked that effort in June.<\/p>\n

Delores Dacosta, the executive director of the South Carolina Commission for Minority Affairs, said it\u2019s important for the Hispanic community to fill out the 2020 Census, because it could affect Hispanic government representation in South Carolina.<\/p>\n

Marilyn Stephens, assistant southeastern regional Census manager, said the Census is offered in 12 languages. She said the Census Bureau will send out an invitation letter, reminder, post card, paper questionnaire and a reminder in that order to each household to ensure everyone is counted accurately.<\/p>\n

Richards said her main concern is finding the right balance. She said this puts immigration advocates in a Catch-22 \u2014 if they encourage noncitizens to fill out the Census, there might be better Hispanic representation in government. But, advocates worry filling out the form puts those noncitizens at risk.<\/p>\n
